Kelsey Farish
Solicitor — Media, Entertainment & AI
I help creatives, performers and innovators navigate complex deals and protect their rights. Based in London, I advise on media and technology matters across the UK, Europe and California, bringing a bit of clarity and calm to high-stakes legal work - especially when it involves the tension between AI, IP, and publicity.
-
I’m a leading legal expert in generative AI—especially where it intersects with creativity, performance, and identity.
Back in 2019, I published one of the first peer-reviewed papers on deepfakes and their impact on the entertainment industry. Since then, I’ve advised broadcasters, AI developers, public bodies, and production companies—but my favourite work is still helping individual artists protect what’s theirs.
That might mean drafting AI clauses and model policies, negotiating cloning rights, or supporting teams as they decide whether—and how—they can safely and ethically use AI on a production.
Drafted model AI clauses and Codes of Practice for Film London to prevent unauthorised scanning, replication, and model training on film locations
Designed a legal risk-rating framework for ScreenSkills to evaluate AI tools and use cases in UK screen production
Consultations for the European Parliament and European Audiovisual Observatory on consent, identity rights, and platform accountability
Provided project-specific advice to broadcasters and production companies on whether and how AI can be used in development, post, and delivery

I help public-facing individuals and brands take control of how they’re seen, credited, and represented. My work covers the full spectrum of visibility and influence — from negotiating talent agreements and endorsements to advising on brand positioning, advertising campaigns, and trade mark use, including ASA and CAP guidance.
A big part of what I do involves supporting talent on Artificial Intelligence matters, particularly digital doubles and voice cloning. I also work closely with brands, production companies, and corporates to shape fair, future-focused policies for how contributors are treated on screen, online, and behind the scenes.
Alongside my day-to-day practice, I’ve published peer-reviewed work on likeness, consent, and creative agency — including “Regulatory and Legal Considerations Relating to Influencer Marketing” (Handbook of Fashion Law, 2025) and “Beauty & the Brand: Drafting Contracts for the Use of Someone’s Likeness” (JIPLP, 2020).
-
I advise on the legal frameworks that govern how information flows online — spanning data protection, content moderation, and freedom of expression. My work sits at the intersection of law, technology, and public trust, shaped by how people live, work, and connect in digital spaces.
I support production companies, creative agencies, tech platforms and public sector bodies in interpreting and applying laws like the EU AI Act, the UK Online Safety Act and GDPR.
At its core, this work is about making sure digital environments are safer and more transparent. This often involves drafting platform terms and privacy policies, advising on AI transparency, or responding to subject access requests and international data transfers.

I help clients protect and make the most of the things they create —whether that’s a short film, a novel, a visual identity, or a dataset.
That might involve negotiating an author’s publishing agreement, helping producers properly license a commissioned work, or advising on revenue-sharing and rights for dramaturgs. On the trade mark side, I run knock-out searches and support brand teams in avoiding infringement risk before they go to market.
In addition to advising producers and artists on copyright issues surrounding AI, other highlights include representing the UK Government in a trade mark opposition over “WINDRUSH” and advising Dogecoin on the protection of its logo. During the pandemic, I advised an NHS trust on their auction of an authentic Banksy piece donated by the artist. (Somewhat difficult given the artist refused to provide any warranties as to provenance - Christie’s had to deal with it…!)
I also hold an MSc in European Law from the LSE, where I focused on copyright and streaming platforms, and completed Harvard’s CopyrightX programme.

About me
I advise on all types of media contracts, but my specialism lies at the intersection of AI, identity, and creativity.
Originally from the U.S. West Coast, I spent the first decade of my career in corporate law firms, advising start-ups, multinational companies, and public sector bodies – including NHS Trusts, the Post Office, and various Government departments.
But a professional turning point occured when I read about an actor who had been the victim of a sexually explicit deepfake. Inspired by her story, in 2019 I published one of the first peer-reviewed papers in the world to explore the legal implications of deepfakes and voice cloning for performers.
I’ve since become an internationally-recognised advocate for those whose work or reputation is impacted by generative AI – as well as by social media, virtual/augmented realities, and beyond.
Some clients come to me with clear questions about a deal. Others are grappling with deeper uncertainties about creative control, profitability, or their brand. But whether they’re dealing with contracts, copyright, or something else entirely, I want to understand what’s keeping them up at night. I want my advice to feel empowering - not overwhemling - so they can decide what works for them.
